In Kalgoorlie the land is generally flat and we have no multiple dwellings.
Is your experience that it is up to the applicant to justify why the
proposal should be assessed as a grouped dwelling? And what reasons are
acceptable?

The definitions of the 1991 R-Codes and 2002 RD-Codes are essentially
similar both for grouped and multiple dwellings.
I would say that some clarification would be required for what the "special
conditions of landscape/topography" are and hence in what circumstances a
grouped dwelling could then be vertically above another and not render this
to be a multiple dwelling.
As I am not aware of the topography/landscape and design of the proposal
that you are dealing with, it would be difficult for me to determine. From
drawing on previous examples, which I have been involved in, I would
classify the proposal as a multiple dwelling, unless the applicant can
appropriately justify why it should be considered and assessed as a grouped
dwelling.

We have an application for a grouped dwelling development, involving 4
multiple dwellings and 21 grouped dwellings one on lot therefore what do
we assess it as? The definitions are:
Grouped dwelling: A dwelling that is one of a group of two or more
dwellings on the same lot such that no dwelling is placed wholly or partly
vertically above another, except where special conditions of landscape or
topography dictate otherwise, and includes a dwelling on a survey strata
with common property.
Multiple dwelling: A dwelling in a group of more than one dwelling on a lot
where any part of a dwelling is vertically above part of any other but does
not include a grouped dwelling.
Therefore is the application assessed wholly under the provisions for
multiple dwellings?
