 Hi Ariel,

The only response I can provide is in relation to the privacy aspect.

You mention that the retaining wall contains a 1.1m high fence which
results in the neighbour overlooking your property.  If you have a look on
your Council's website they should have a Local Law relating to dividing
fences.  Within this document you'll find standards for a sufficient fence
which generally provide for a dividing fence to be constructed at 1.8m in
height.  You may also find that the word 'height' is defined as "the
height of the fence from the higher ground level whether natural or
retained".  In which case the current dividing fence is not deemed to be a
sufficient fence and you have some right to request the fence height be
increased to provide additional privacy (mind you under the Dividing Fences
Act you may be liable for part of the costs associated with the replacement
of the fence).

Aside from this I am unable to provide you with any more assistance
without further information.
